1. Definitions

• AIRGROW, we, us: the legal entity named above.
• Client: the business or organisation that enters into an agreement with AIRGROW.
• User: a person who has access to the Service on behalf of the Client, such as a team member.
• Service: the online AIRGROW platform with features for SEO analysis, social media analytics, publishing and scheduling content, team management and reporting, plus any additional services in the chosen plan.
• Third-party platform: an external service the Client connects to the Service, such as Google, YouTube, Instagram and TikTok.
• Content: all texts, videos, images and other materials the Client or a User uploads or publishes through the Service.

2. Applicability

These terms apply to every offer from AIRGROW and every agreement about the Service. The Service is intended exclusively for businesses and organisations, not for consumers. The Client’s own terms do not apply unless we have accepted them in writing.

3. Offer and agreement

Our offers are without obligation. The agreement is formed as soon as the Client creates an account and chooses a plan, or when we confirm an order in writing or by email.

4. Trial period

A new account can start with a free 14-day trial. If the Client does not stop before the end of the trial, the chosen plan starts automatically and the first monthly fee is due. We may refuse or end a trial without giving reasons.

5. The Service

We provide the Service as described on our website and in the chosen plan, with care and in line with current technology. This is a best-efforts obligation: we do not guarantee any particular search ranking, number of followers, views or other results.

We may improve the Service and change features. If a feature that is essential to the Client is removed, the Client may terminate the agreement as of the date of the change.

6. Third-party platforms

For analytics and publishing, the Service uses the official integrations (APIs) of third-party platforms. The Client gives permission through the platform’s own login screen and can withdraw it at any time.

The availability, features and limits of these integrations are determined by the third-party platforms. We are not liable if a platform changes, restricts or ends its integration, or refuses, removes or restricts an account, post or video.

When using an integration, the terms of that platform continue to apply to the Client in full, including the YouTube Terms of Service and the terms of Meta and TikTok.

7. Client obligations

• The Client is responsible for all Content posted through the Service and guarantees it holds the necessary rights, including rights to music, images and trademarks.
• The Client does not use the Service for spam, deception, unlawful content or actions that breach laws, regulations or the terms of third-party platforms.
• The Client keeps login details secret, gives Users only the access they need and is responsible for actions taken through its account.
• The Client indemnifies AIRGROW against third-party claims arising from Content or from use of the Service in breach of these terms.

If we suspect a breach, we may block Content or temporarily suspend access to the Service.

8. Prices and payment

Prices are shown in the currency of the chosen plan and exclude tax. Plans are invoiced monthly in advance and paid through a payment method we offer. If a payment fails we send a reminder. If payment is still outstanding after 14 days, we may suspend access until payment is made.

We may adjust prices once a year. We announce any price increase at least 30 days in advance. The Client may then terminate as of the date the increase takes effect.

9. Term and cancellation

Plans run monthly and renew automatically. The Client can cancel at any time through the dashboard or by email; cancellation takes effect at the end of the current month. Fees already paid are not refunded. A different term may be agreed in the quote for the Managed plan.

After termination the Client can export its data for 30 days. After that we delete the data, except what we are legally required to keep.

10. Availability and support

We aim for the highest possible availability but do not guarantee uninterrupted operation. Planned maintenance is done outside office hours where possible. Support is available by email on business days.

11. Intellectual property

All rights to the Service, the software, the design and report templates remain with AIRGROW. The Client receives a non-transferable right of use for the term of the agreement. The Client remains the owner of its own Content and data.

12. Privacy and data processing

Personal data we process on behalf of the Client is covered by our data processing agreement, which forms part of these terms. How we handle personal data ourselves is described in our privacy policy.

13. Liability

Our liability is limited to direct damage and to a maximum of the amount the Client paid us in the three months before the event causing the damage. We are not liable for indirect damage, including consequential loss, lost profit, missed savings, loss of data or reputational damage. These limits do not apply in case of intent or gross negligence by AIRGROW.

14. Force majeure

We are not obliged to perform in case of force majeure, including outages at hosting or internet providers, outages or changes at third-party platforms, cyberattacks and government measures.

15. Changes

We may change these terms. We announce changes at least 30 days in advance by email. If the Client does not agree, it may terminate as of the date the change takes effect.

16. Governing law

These terms and all agreements are governed by Dutch law. Disputes are submitted to the competent court of the District Court of Northern Netherlands (Rechtbank Noord-Nederland).

This policy explains which personal data AIRGROW processes, why, for how long and what rights you have.

1. Who we are

AIRGROW is a trade name of [Legal entity], [address], Meppel, the Netherlands, KvK [KvK number]. We are the controller for the processing described here. Privacy questions: privacy@airgrow.nl.

For data that our clients process in AIRGROW themselves, such as data about their team members and connected accounts, we are the processor and the client is the controller. We sign a data processing agreement for this.

2. What data, why and on what basis

We never sell your data and do not use it for advertising.

3. Data from Google, YouTube, Meta and TikTok

When you connect an account, we only receive the data you give permission for through the official integration. We use it solely to provide AIRGROW’s features: showing statistics, creating reports and publishing the content you submit. You can disconnect at any time in your dashboard or in the platform’s own settings.

Google. AIRGROW’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

YouTube. AIRGROW uses YouTube API Services. By connecting your YouTube account you agree to the YouTube Terms of Service. The Google Privacy Policy applies to data processed by Google. You can also revoke AIRGROW’s access through the security settings of your Google account.

4. Who we share data with

We use a limited number of service providers, each bound by agreements on security and confidentiality.

If a provider processes data outside the European Economic Area, we ensure appropriate safeguards such as the European Commission’s standard contractual clauses. We only disclose data otherwise when required by law.

5. How long we keep data

• Account data and data from connected platforms: as long as you are a client. After cancellation you can export for 30 days, after which we delete it.
• Access tokens: deleted immediately when you disconnect.
• Invoices and accounting records: 7 years, as required by law.
• Free SEO scan data: 12 months, or sooner on request.
• Contact messages: 12 months after handling.
• Log files: up to 6 months.

6. Security

We protect your data with, among other things, encrypted connections (HTTPS), encrypted storage of passwords and access tokens, strict separation of data per client, permissions per user and daily backups.

7. Your rights

You have the right to access, correct and delete your data, to restrict and object to processing, and to data portability. Where you gave consent, you can withdraw it at any time. Send your request to privacy@airgrow.nl; we respond within one month. If you disagree with how we handle your data, you can file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or the supervisory authority in your own country.

8. Cookies

We only use functional cookies and local storage. Read more in our cookie policy.

9. Changes

We may update this policy. The date at the top shows when it last changed. We inform clients by email of important changes.

AIRGROW does not use tracking or advertising cookies. We only use what is needed to make the website and the service work. No consent is required for this, so there is no cookie banner.

External services

We load Google Fonts for typography. Google receives your IP address when this happens. If we ever add analytics or marketing cookies, we will ask for your consent first and update this policy.

Delete your data

Instructions for deleting your data

Do you want AIRGROW to delete your data, including data from connected accounts such as Instagram, TikTok or YouTube? Here is how.

Disconnect an account

1. Log in to AIRGROW and go to Connections.
2. Choose the platform and click Disconnect.
3. We delete the access token immediately and the statistics of that account within 30 days.

You can also revoke access through the platform itself: on Instagram under Settings, Apps and websites; at Google through the security settings of your Google account; on TikTok through the app settings.

Delete all your data

Send an email to privacy@airgrow.nl with the subject Deletion request and include the email address of your AIRGROW account or the name of the connected account, or use the form below. We confirm your request with a reference number and delete your data within 30 days. We only keep data we are legally required to keep, such as invoices.

Data processing agreement

As an AIRGROW client you are the controller of the personal data you process in AIRGROW, such as data about your team members and connected accounts. AIRGROW processes this data as a processor, solely on your instructions. The key arrangements are below.

1. Subject and duration

AIRGROW processes personal data only to provide the Service, for as long as the agreement runs.

2. Types of data and data subjects

Names, email addresses and roles of Users; account names, statistics and content from connected platforms; Search Console data. Data subjects are the Client’s Users and, where applicable, people in the Client’s content or statistics.

3. AIRGROW’s obligations

• Process only on the Client’s documented instructions, as set out in the agreement and the Service settings.
• Impose confidentiality on everyone with access to the data.
• Take appropriate technical and organisational security measures, as described in the privacy policy.
• Assist the Client with data subject requests and data protection impact assessments.

4. Sub-processors

The Client gives general permission for the sub-processors listed in the privacy policy. We announce a new sub-processor at least 30 days in advance. The Client may raise a reasoned objection.

5. Data breaches

In the event of a personal data breach we inform the Client without undue delay and, where possible, within 48 hours of discovery, with the information the Client needs to meet its notification obligations.

6. Audit

Once a year, at its own expense and with reasonable notice, the Client may have AIRGROW’s compliance with these arrangements audited.

7. End of processing

After the agreement ends, the Client can export its data for 30 days. AIRGROW then deletes the data unless retention is legally required.
